It is Myxer's policy to respond to notices of infringement that comply with the Digital Millennium Copyright Act (DMCA)
and other applicable intellectual property laws. Myxer's PROTECT program allows content publishers to automatically
submit notices of infringement. It's important to note that using our PROTECT program to submit takedown requests is
intended to be legally and functionally equivalent to sending us a DMCA notification, e.g., via email, fax, or postal
service, and requires that you submit the same information required by the DMCA for infringement notices. The DMCA
requires specific things of parties requesting takedowns and misrepresenting that material or activity is infringing
could expose you to serious legal penalties, and liability for damages (including costs and attorneys' fees). We
recommend that you first consult with an attorney if you are not sure whether material available on Myxer infringes
How It Works
Once you've registered to use PROTECT and you're logged in, you will see a PROTECT Toolbox (see example below) at the
bottom of each item page that contains a link to request a DMCA Takedown.
When you click the "Takedown" link, you will be asked for the information required under the DMCA. This includes
assertions that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Upon submission of a takedown request:
- A DMCA notification is sent to Myxer's Copyright Compliance Officer;
- The reported item is disabled if appropriate;
- An email is sent to the person who posted the item notifying them that the item has been taken down, and
to give that person an opportunity to make a counter notification; and
- A confirmation email will be sent to you.
Any and all counter notifications received will be furnished to you. We will give you the opportunity to
seek judicial relief in accordance with the DMCA before we replace or restore access to any material as
a result of any counter notification.
